Rejecting cars on contract hire

Hey,

Anyone got any info on who i need to approach to reject this car,

Brand new ZS has broken down 3x to be told there is no fault with the car, they have replaced stuff and updated stuff, bit strange if theres no fault?

MG are refusing to budge saying the deal says no issues, the dealer is saying 3x recovery isnt normal there is something wrong but their reader says no so they have to go by that.

Getting to be a joke, ive spent half the time without the car, 1/4 with some crappy car they gave me to run around in.


Honestly, if you have a ZS or thinking of one in Scotland, do not buy this, save yourself the hassle go else where, car is lovely dont get me wrong just not work spending my hours waiting in the cold for recovery to come to be told theres no issue next week...

Im getting to the end of my wick with this, spending days off work to ponder about the garage, the car has a undiagnosed fault / compatibility issue that the readers dont detect so because of that im now stuck. Garage cant help me since its contract hire, MG dont want to do anything about it, is my only last action going to trading standards etc and the papers?

Have a look in the hire contract for clauses of when the vehicle is not fit for purpose.

I have, gave them the stuff to prove it they just browsed over it, like i have the charger logs to say fast slow etc, cant tell me im not swapping them where possible and its my fault when i can prove you wrong? See what they say next else going to have a good fun putting this about the place, papers always love a good story.
 
How long have you had the vehicle? If within 6 months, but over 30 days you have given them the option of repairing the vehicle, which has been unsuccessful.

You can reject the vehicle under the Consumer Rights Act 2015 and you also have protection under the Consumer Credit Act 1974. I would go back to the finance company and confirm you wish to reject the vehicle as the same issue is happening and no solution can be found. The hire company and MG are required to provide a vehicle that’s fit for purpose under the legislation. As the hire company need to agree for you to reject the vehicle (as they own it) you need to let them know this is what you wish to do and do it in writing. There are template letters available via Which etc.

If the dealer agrees there is an issue, then I’m not really sure what else the Hire Company require other than another check by a third party. You may need to ask them what else they want? It’s then a case the company providing the finance needs to take this up with MG and the dealer to get the rejection processed as they have already had ample opportunity to repair. If you’re having issues then I’d speak to a lawyer who specialises in these types of disputes as the longer it goes on the harder it is to reject. I’d also make sure everything you get is in writing from now on incase you need to pursue it further. This includes correspondence with the dealer agreeing the issue can’t be fixed.
 
Following emma829's comments, I would also ask the dealers for a print out or other written record of what was done to diagnose the fault so that a third party (such as the AA or RAC) can make their own assessment if needed. Also, start a backdated diary of events and actions taken so you have a time line to present as evidence (can you tell I made a successful small claims court claim years ago on a recon engine?).

Sent them over the stuff, asked them to get the garage reports and I want to see them.

The recovery guy first hand wrote this

"We have arranged for a recovery of your vehicle.Tried various resets. No comma with bosch. Battery fault prevents starting and charging. And no option to clear etc. Gave customer lift home and arranged recovery"

Lets see what bullshit they hit me with now
 
If its contract hire then who is thjat contract with? They are the people you need to talk to as they are the only ones that you have a legal relationship with.
 
Has it had the latest updates (as per recent podcast) and have your issues always followed rapid charging?

Pretty sure that as it's contract hire, your contract is with the finance company you make payments to, not MG or the dealership. You should try and get them involved.
