Just a thought maybe getting in touch with Martin Lewis the financial journalist money saving expert etc , IAM sure his team could perhaps guide you on the correct path , IAM sure MG and the dealership would hate his involvement? Just a thought.
 
Martin rarely handles specific cases ... he looks for trends to influence; the "big hitters".

I'm not saying Don't Try - just adding a note of realism. One of the Consumer Champions from a national newspaper may be a better bet for such an action. :)

A quick update on this crazy situation.

Were now over 9 weeks into this email ping-pong. The dealer is losing patience with me and is clearly irritated that I'm not taking their word that my warranty has not been compromised and their service done will comply with MG requirements (even though 12 items on the 38 point list were not done). He told MGUK that I was relentless in pursuing this - too damn right I am and intend to continue until it's resolved. MGUK have responded to my emails but have been vague at best, in a direct question "In view of this service work, has my warranty been compromised?" the closest answer to a YES / NO has been "potentially". I have pushed time and time again to get a straight YES/NO answer and they wont, they often quote T&C's and the service regime. Maybe they're being diplomatic to the dealer network. I have now informed them that I'm going to raise a case with the motoring ombudsman which has started new activity but my patience is now running thin. I'm also preparing an email to Santander who did the MG/PCP finance.

Just a word of warning you do realise the motoring ombudsman is funded by the manufacturers and it could potentially drag out for months, the organisation is basically put in place to stop you going the court way first . I would suggest checking reviews online regarding the ombudsman route first , my brother went the court way and it was sorted before it got to the courts , bad press and all that stuff..

Thanks for the heads up, I'm happy to deal via the courts in view of what you've said. I'll change tack and start the paperwork, in my experience if you present any case well, good documentation etc, the courts are pretty efficient and in the past have always found in my favour.
Did your brother use a solicitor or DIY via small claims court / money claim online?

He used a solicitor but the only cost was a letter, that was enough for the garage to go into panic mode and my brother got his money back and luckily the car he had traded in also .just be mindful laws in Scotland are different I think ?

Aye, probably different in Scotland but near enough the same in principle. I have emailed the garage to tell them in 7 days time I will be going via the court route rather than the Ombudsman. I'll give it a go the DIY route, save some money LOL.

If going via court (MCOL ... Money Claim Online) then be mindful of the claim amount; once it exceeds a certain value (or claim complexity) then the claim may be pushed to the Fast track rather than the Small Claims track. In the SC track costs are limited, such as limited solicitor fees of about £50; in the Fast track the winning party can claim full legal representation fees, so could be in the thousands.

This minefield just gets bigger and bigger. It's incredible that I've done all of the right things, MG's finance, GAP Insurance, Maintenance Contract all so I didn't have the slightest worry during the 4 years of ownership of this car. Now look where I am, what on earth did I do wrong?

Hi John the only thing you did wrong was like everyone else on this forum you bought an MG , The sales staff sell you a car all good ,👍 then when something goes wrong after sales. And MG UK are the most useless bunch of morons I've ever dealt with it's just constant scripted utter bullshit that flows from their mouths. Like I said once they get notification of court proceedings they will change their tune , 😉

I'm trying to document what I want from this action. Ideally I want in writing from MG confirmation that my warranty has not been compromised in any way. If MG cant or wont confirm this I think I have to go along the lines of the garage take the car back, settle all of the finance with no detriment to me or my record, return 50% of the deposit I paid and return all of the maintenance payment s from the end of year 1. All of this based on it going wrong from the end of year 2.
I'd appreciate peoples thoughts on this.

There are some favourite phrases solicitors use, like "duty of care" and "with out predudice" etc. Sprinkle some of those about for good measure.

Quite right about being clear what you want from them and give them a deadline.

ChatGPT might be able to draft you a letter in jargonese.
