OS software owner and aggrieved owner will have to team up to gain any traction at all as suggested earlier. SAIC will just say sw was a freebee under gpl.

If the German authorities decide the car is not allowed to be used, there is damage.
It is similar to a case where each car manufacturer has to state a car functions according EU 2021/646. This regulation contains the demands for an EU type-approval of vehicles with regard to their emergency lane-keeping systems.
If a car does not comply with this regulation, type approval could be rejected or withdrawn. That car is no longer allowed on the European roads.
