If I ever need a courtesy car (because my car is with them for warranty work) then I'll laugh in their face if they ask me to pay anything towards the courtesy car.

After 2 months (of loving the car tbf) and no issues, I suddenly had a flash up of "Motor Fault" and the car stopped. I restarted, all fine, 2 mins later (on a hill) same issue. As I travel the M25, I couldn't risk it. Dealer told me the oil was black, mostly gone and had swarf. Now I'm told it's the "known oil leak" and requires a rebreather.

Surely needs a new gearbox not just a new (re)breather?

Sounds like. Some tiny material in the oil is normal as part of the running in process but if there's big bits and been a fault in the motor system, highly likely it needs replacing.
